Requirements under the Design & Building Practitioners Act 2020 for Strata Managers

 

The NSW Government has developed a reform package with the intention of transforming the NSW building sector with a refocus on quality construction and remediation.

The new Design & Building Practitioners (D&BP) Regulation affects most medium and high-rise strata buildings (where people live above each other is generally a class 2 building under the Building Code Australia) and is relevant to designs for new buildings, modifications and additions to existing buildings, and major maintenance and remediation to existing strata buildings. Certain types of projects will need to be run by an engineer.

AEGIS' Civil and Structural Engineers are Chartered with Engineers Australia, and we are registered Design & Building Practitioners and Engineers for strata buildings of all sizes.

This means that our team at AEGIS can inspect, report, scope and specify, and then contractually oversee any major maintenance and remediation projects as is now required by the D&BP Act.

We appreciate that this is new territory; where strata managers are strata governance experts, we see our role as technical and project delivery experts and always want to get the best outcome for Owners Corporations and building owners. MANDATORY DEFECTS INSPECTIONS FOR NEW STRATA SCHEMES

Of the strata schemes constructed in the last 10 years 85% are
reported to suffer from at least one form of building defect. Owners Corporations are often the losers when it comes to building defects in their strata scheme, incurring large costs in order to carry out rectification works. With 25% of greater Sydney’s population currently living in strata schemes and predictions that this will rise to 50% by 2040, the NSW Government’s new strata and building regulations aim to tackle the perennial problem of defects in new builds.

Defects inspections by an independent inspector for new
strata buildings are now mandatory.
The Building Inspector:
- Must not be connected to the developer
- Must act impartially
- Cannot represent the interests of the developer

Generally an ‘Interim Report’ should be undertaken between
15-18 months after the building work is complete.

We Can Assist

Aegis' Independent Chartered Professional Engineers are qualified
with Engineers Australia to undertake Defects Inspections.
We can also assist with escalation of defects resolution and
rectification processes. We have a proven record of identifying
defects, where the cost savings far outweigh the cost of the
inspection, and rectification works costs would otherwise be
borne by the owners.

And I’m working as an expert witness engineer on a building defects matter on behalf of a strata building.

Some other Aegis team members have been logistically impacted by the latest lockdown changes but so proud of how our team has quickly rejigged our plans and workloads.
